La batalla detrás del escenario: de la precariedad a la emergencia

Abstract

Esta investigación se centra en el estudio de la crisis de acceso a derechos sociales y laborales del gremio artístico actoral en el marco de la pandemia de COVID-19 en México. A pesar de que dicha actividad está reconocida por la Unesco desde 1980 como trabajo cultural, y de que existe un aparente compromiso asumido por el Estado mexicano al adherirse a diversos tratados internacionales que lo contemplan para su protección, el gremio sigue sin alcanzar el pleno reconocimiento y acceso a derechos legales y económicos. Los resultados revelan que la actividad, en muchas ocasiones, sigue sin ser reconocida como un trabajo que debe ser remunerado, debido a aspectos subjetivos como el llamado “amor al arte”, que se interpreta como exigencia implícita de vocación, renuncia y resiliencia en la profesión artística. Otros aspectos estructurales entran en juego, como el hecho de que, aunque la Ley Federal del Trabajo cuenta con un “Título de los trabajos especiales”, que incluye esta actividad, no ha logrado garantizar los derechos laborales de este gremio, pues es difícil demostrar su calidad laboral subordinada. Por último, se observará que existen fuertes restricciones para ejercer el derecho a la acción colectiva.

This research focuses on the crisis of access to social and labor rights of the acting/artistic guild in the context of the COVID-19 pandemic in Mexico. Despite the fact that this activity has been recognized by Unesco since 1980 as cultural work, and that there is an apparent responsibility assumed by the Mexican State by the observance of various international treaties that provide for its protection, this guild still has not achieved full recognition and access to legal and economic rights. The results show that the activity, on many occasions, is still not recognized as a job that should be remunerated, due to subjective reasons such as the so-called “art for art’s sake,” which is interpreted as an implicit demand for vocation, acceptance and resilience in the artistic career. Other structural elements are involved, such as the fact that, although the “Ley Federal del Trabajo” (Federal Labor Law) has a “Title of special jobs,” which includes this activity, it has failed to guarantee the labor rights of this guild, since it is difficult to prove a “subordinate working position”. To finish, it will be pointed out that there are strong restrictions to exercise the right to collective action.
